Notary of contracts, housing transactions

Housing documents and contracts must be notarized including: + House purchase contract among individuals, + Given house contract among individuals, + Mortage house contract, + Rental house contract of individuals from 6 months upwards + Minute of inheritance division; + Statement of inheritance.

A. Notary of compiled contracts, transactions beforehand

1. Documents of notarized housing contracts, transactions

-Requirement bill of notary (issued by notary office)

-Draft proposal of contracts, transactions;

-Copy of identity documents;

To Vietnamese overseas, it should be attached with verified documents of having full conditions to get involved in housing transactions such as Legal passports, certificate of Vietnamese citizen…

2. Notary procedures

-Step 1: All sides go to notary office to submit for notaries, added with original documents of land use rights used for comparing.

-Step 2: Notaries receive documents and notarize. In this case, it is necessary to identify all related matters to notarize or proceed investigating, identification. If it is not clearly done, documents will be sent back.

-Step 3: Notaries will check drafts, if the content is wrong; it’s a must for notary to correct it. If draft is not recorrected then refuse notarizing and paying documents back.

-Step 4: Two sides will read drafts again and sign into the contracts, transactions. Notary receives contracts, transactions.

-Step 5: The side which has documents to notarize will pay notary fee and receive notarized contracts, transactions.

B. Notarize contracts, transactions compiled by notaries

1. Documents for notarizing housing contracts, transactions

-Notary requirement bill;

-Copy of house use rights;

-Copy of identity documents

2. Procedures for notarizing contracts, transactions

-Step 1: All sides go to notary office to submit for notaries, added with original documents of land use rights used for comparing;

-Step 2: Notary office will consider, if having fully conditions, the contract will be formed. If necessary, let’s check and do transactions;

Notary time: 2 working day. If doing contract, complex transactions will be 10 days maximum. Time for checking, verifying (if needed) is not gotten involved in notary due date.
